что значит - кто ринется, если через 3- месяца только perm и останется?
или вы имеете ввиду, кто с rir и regular захочет кейс переводить? В любом случае это можно будет делать только 9 мес (бишь до конца года).

ну если рекламная кампания уже проведена - то собсно только и остается что файлить по-старому, потому что (скорее всего) она не удовлетворит требованиям perm. Так что вопрос может стоять так - стоит ли файлить что есть или еще раз потратиться на рекламу и зафайлить (через 6 мес) perm

PERM FILING
PERMANENT ELECTRONIC RECORD MANAGEMENT (PERM)
LABOR CERTIFICATION FILING SYSTEM

This memo is to update you regarding the newly implemented immigration law pertaining to the labor certification application filings. On December 27, 2004, the Department of Labor (DOL) published a new regulation to overhaul the existing labor certification application process. The labor certification process is the first step in one’s pursuit of the U.S. permanent residency based on employment sponsorship. If you have a labor certification application currently pending with the DOL or are interested in filing a labor certification application, we strongly encourage that you contact us immediately to schedule either an in-person appointment or a telephone conference to discuss about your matter. This memo will provide a brief description of the PERM filing, the conversion process which the regulation provides for the pending applications, and the initial documentation we need to begin new PERM application preparation.
PERM FILING
Please note that the new regulation will allow employers to file labor certification applications electronically starting March 28, 2005. This electronic filing system is called Permanent Electronic Record Management (PERM). The processing time for PERM filings is expected to be between 45 to 60 days from the date of filing. The existing regulation will no longer be valid after March 28, 2005. At the present time, you may still file a labor certification application under the existing regulation. However, after March 28, 2005, you can only file an application under the new regulation, which will require you to perform the following steps before you file your application.
1. Obtain Prevailing Wage Determination (PWD) that is specific to your job opportunity from the State Workforce Agency (SWA) in charge of the area of the intended employment. Employer is required to file its application or commences the pre-filing requirement during the validity period of the PWD.
2. Conduct the pre-filing recruitment efforts, which consist of the following:
a. Employer must place a job order with the SWA. Job order is to post the job opportunity in the State’s job bank and the State will refer job applicants to contact employer for the position opening.
b. Employer must place two classified ads in the Sunday edition of a newspaper that is most appropriate for the position in question.
c. If your job opportunity is a professional job, employer must also perform any three of the following recruitment steps (one of the recruitment efforts below must be done within 30 days from the date of filing the application).
i. Job fairs.
i. Employer’s website.
ii. Job search website other than the employer’s.
iii. On campus recruitment
iv. Trade or professional organizations.
v. Private employment firms.
vi. Employee referral programs with incentives.
vii. Campus placement offices.
viii. Local and ethnic newspaper.
ix. TV and Radio ads.
3. For all recruitment efforts, employer must: a. keep track of single and every applicant that applies for the job opportunity, b. provide lawful related reasons for rejecting the applicants, and c. establish a recruitment report to detail the employer’s recruitment efforts, number of responses, and its reasons for disqualifying US workers.
4. If there has been a layoff in the business (6 months prior to the filing of the application), employer must attest that it has notified and considered those potentially qualified laid-off US workers for the job opportunity.
After you have completed the above steps, then the employer will be ready to file the application electronically. Keep in mind that the above recruitment steps will take at least 30 to 60 days, if not more, to complete. If you are interested in filing under the PERM system, you must consult an attorney for assistance.
CONVERSION PROCESS
If you have already filed an application under the existing regulation and the application is currently pending, you may consider re-filing the application under the PERM system using its conversion procedure. The new regulation allows the existing pending applications to be converted to the PERM system. The conversion process is as follows:
1. Withdraw the existing application. (DO NOT WITHDRAW YOUR APPLICATION UNTIL YOU HAVE DISCUSSED WITH YOUR ATTORNEY REGARDING THE SPECIFICS OF YOUR CASE.)
2. Re-file the application for the identical job opportunity (the position and requirements as stated in the first application must be identical in the second application filing under the PERM system).
3. Re-file must be done within 210 days after the date of withdrawal.
4. The new PERM application must comply with all of the requirements under the new law, which means that the employer will have to re-advertise, keep track of the responses, and evaluate the qualifications of US workers applied for the position.
Benefit
Faster adjudication and therefore a shorter waiting period for most applicants.
Risk and Cost
Like any other case, conversion application may be denied. You will end up with no application pending whatsoever and you will need to re-file the application again under the PERM system (if you have a different employer sponsoring you for another labor certification application, you can still keep your existing application pending and file for a new one under the PERM system through your second employer, or it may be possible to file under the PERM system without withdrawing your existing application, if your petitioning employer has a different job opportunity for you – need to examine these two issues very carefully).
Additional legal fee and cost for the second labor certification filing.
Whether you should convert your existing application to the PERM filing will depend on a number of factors, which include the current status of your application (if your application has been pending for less than one year and you still have, let’s say, two more years of waiting period to go, you may want to consider re-filing the application), your financial status, your employer’s willingness to undertake another recruitment process, and the current labor market condition, etc.

INITIAL DOCUMENTATION REQUESTED FOR THE PERM FILINGS
For those individuals who are interested in retaining us to represent you in your PERM filings, please gather the following documentation as soon as possible and contact us for an appointment.
If you have an application currently in process with us, we should have some of the information as requested above for your case. We will work on the PERM filing for your case and let you know of any additional information or evidence that we need from you. 1. Legal name, street address, telephone number and fax number of the employer.
2. Name and title of the company official who is authorized to sign the application and who will serve as the point of contact in behalf of the employer in the event of DOL audit. Please provide his/her direct phone number, email, address, and any specific instruction in how he/she can be reached)
3. Number of the employees currently employed by the employer in the area of intended employment.
4. Most recent tax return for the employer, if the company has less than 100 employees.
5. Year upon which the business was established.
6. Employer’s Federal Employer Identification Number (FEIN)
7. Does the alien have any ownership interest, or is there a familial relationship between the (owners, stockholders, partners, corporate officers, or incorporators) and the alien? (YES/NO)
8. Full address of the primary site or location where the work will actually be performed.
9. Position Title offered to the alien.
10. Salary offer (we will obtain the PWD for this position from the SWA to determine if the employer’s salary offer meets the prevailing wage requirement).
11. State the minimum education requirement for the position offered
12. Indicate whether or not training is required for the job (YES/NO). Training is not the same as education or experience requirement. In other words, does the job require the worker to specifically undergo training? If so, what kind of training and for how long?
13. State the minimum experience requirement for the position offered.
14. Description of job duties and responsibilities
15. State any special skill requirements, such as computer technologies, languages, knowledge of specific area of expertise, etc. which are absolutely critical and necessary for the job and without which, the worker will not be able to competently perform the required duties.
16. Provide description of the skills needed for the job and how they are applied in the day to day activity (may be necessary to provide project description, if the employer requires a certain set of skills because of the project requirement).
17. Please indicate on the alien’s resume as to with which employer(s) did s/he acquired these skills, how long would it take for a person to acquire the sufficient proficiency to perform the job (whether 90 day training period is sufficient for a person to be trained).
18. How many workers at the employer’s jobsite have the identical set of skills?
19. What would happen to the job if the employer hires a person without the required skills?
20. Alien’s personal information: legal name, birth and place of birth, country of citizenship, type of immigration status, alien registration number, and alien’s I-94 number (please provide a copy of the most recent passport, I-94, visa stamp page, USCIS approval notice(s), and any other immigration related documents for the alien).
21. Resume for the alien worker (must include the month and year of employment, number of hours per week worked, and education attendance, as well as the specific addresses and type of business of all employers listed on the resume).
22. Complete copy of the alien’s university/college diplomas, transcripts, and foreign credential evaluations.
23. Total number of years that the alien spent in school.
24. Specific street address of the institution from which the alien obtained the highest relevant education for the position offered.
25. Did the alien gain any of the qualifying experience with the employer in a position substantially comparable to the job opportunity requested? In other words, if the alien has already been working for the petitioning employer who is now going to sponsor him/her for a labor certification, did the alien have the necessary qualifications for the job prior to joining the employer?
26. Did the employer pay for any of the alien’s education or training necessary to satisfy any of the employer’s job requirements for this position?
27. Is the alien worker currently being employed by the petitioning employer?
28. Has the employer conducted any recruitment efforts as outlined above within the past 6 months? If so, please identify the mean of recruitment and the approximate dates. We will inquire with the employer to find out more information about the overall recruitment process.

да, я именно это и имею в виду - очень много народу ждет своего rir and regular годами, наши адвокаты очень полагаются на ПЕРМ. Я боюсь, что это будет как в магазине - приходит новый продавец, открывает новую кассу и старая очередь бросается туда, - кто-то выигрывает, а кто-то оказывается еще дальше, чем стоял .
Перм обещает делать лс в течении 45-90 дней. Но не образуется ли там за первые несколько дней очередь на год?
Те, кто будет файлить ПЕРМ просто из-за того, что раньше ничего не файлили вообще, будут стоять в очереди ЗА теми, кто будет переводить кэйс. Потому что дата сохраняется при переводе кэйса.

PERM будет ограничивать квалификацию больше, чем было раньше. Если бы был выбор ждать полгода PERM, но с большой вероятностью плохого исхода, либо ждать полтора года RIR, но с меньшей вероятностью плохого исхода, то я выбрал RIR. Проблема в том, что мой штат делает RIR около трех лет. Так что PERM сейчас выгодней делать. Даже если все ринуться на PERM. Правительство обещает, что сроки будут меньше, чем сейчас на RIR. Хотя правительство на то оно и правительство, чтоб давать не сбывчивые обещания.

Да нет, похоже -они только 7-го января получили от нас DRAFTs ETA-750 (A&B).
Я сегодня их по емэйлу спросил, и копию послал в наш HR - ответственному человеку

во всем есть свои положительные моменты. если основная масса индусско-китайско-филлипинских трудящихся ломанется на perm, то им надо будет заново проводить рекламную компанию. соответственно, это вызовет шквал "просто объявлений" без детализации, а значит есть шанс, что Ваше объявление пройдет незамеченным, а значит и придраться клерк к вашему кейсу не сможет. главное попасть в струю.

45-60, но адвокаты сомневаются в реалистичности. С другой стороны решение будет приниматься только на основе электронной анкеты, а это значительно ускоряет прОцесс...

Если бы был выбор ждать полгода PERM, но с большой вероятностью плохого исхода, либо ждать полтора года RIR, но с меньшей вероятностью плохого исхода, то я выбрал RIR. Проблема в том, что мой штат делает RIR около трех лет. Так что PERM сейчас выгодней делать. Даже если все ринуться на PERM. Правительство обещает, что сроки будут меньше, чем сейчас на RIR. Хотя правительство на то оно и правительство, чтоб давать не сбывчивые обещания.
все хуже. все regular & rir - 24-30 мес, отсчитывая от 28 марта... для всех, без привязки к штату. национальное бедствие.

Откуда дровишки?
От адвокатов вестимо. Fragomen и компания "радуют" еще больше. По их мнению обработка LC в бэклогах не начнется пока все кейсы не будут переведены. Сейчас только 1/3 переведена. До конца года ожидают что 2/3 будет законченно. Ну и с середины следующего года начнут обрабатывать в течении 2-3х лет.
Это из письма посланного в HR и моему начальству. Начальство сказала ну и фиг с ним, подождем.

Я читал на форумах посты от народа, подавшего в 2001 году что они уже получили от бэклог-центров одобрения. Я забыл правда, что за форум был - случайно гуглом наткнулся. Я кину ссылку если опять наткнусь.
