adjustment of status for DV05 winners
Wife is a DV2005 winner, she's on H4 here (my dependent, I'm on H1). Are we eligible to adjust our status?
If we are, when can I go to local USCIS for instructions, forms, etc.?
More precisely, after fiscal 2005 year starts (October 1st, 2004) or any time earlier?
When can I submit the application (AOS forms) to local USCIS office, after fiscal 2005 year starts (October 1st, 2004) or any time earlier?
PS: Spoke with USCIS CSR today: 20 minutes on hold, 10 minutes of explanation that my call is in a scope of DV2005, not 2004, 10 minutes reading my letter from KCC so that he could understand in what connection KCC refers to USCIS, ...
The outcome: no response about eligibilty, advised to call again after October 1st for ... I don't know what for, probably for the same thing - 20 minutes on hold, 10 minutes of explanation that ... blah-blah-blah.

Yes, you are eligible to adjust your status. Didn't your instructions tell you that????
And, one more thing, it looks like it's actually faster to do consular processing, than AOS, since many people were late for AOS because they have to wait to send their documents in until their number is current and because of longer security checks. So, if you can spare a month or so to go back home to do consular processing, by all means, you can do it. You can send the docs in right now if you do consular processing.

The instructions for the forms are so straight forward, shop around for the immigration doctor, since the prices are different.

You can pick up forms now, but you'll be able to submit them only when your number is current (true for Phila office) some take applications 90 days in advance but still not before Oct1-2004.
You can pay your $100 (for each person) to Dep of State now and have your reciept handy, send your form to DOS that you are going to so AOS, so they know and will be ready to send your file to INS when nessesary.
There is a lot of wait, so be prepared, but the outcome is very SWEET

Спрашивать Вам все эти вопросы есть смысл, если номер у Вас МАЛЕНЬКИЙ. Или если Вы не будете переживать, если не успеете пройти AOS до 30 сентября 2005 года. Все зависит от НОМЕРА и традиций вашего МЕСТНОГО INS.

No, they did not. Instructions say "you MAY be eligible if you are in USA... Immigration law has recently changed ... Please contact USCIS to see if you are eligible..."
when can 12xxx number become current? Mid-winter?
local office is in Philly, they don't process I-485 anymore rather send it to another (central?) office.
The last (hopefully) question: can I apply for CP now and change my mind later (after October 1) and continue (or start over) with AOS ?

Hypothetically, you can apply first for CP, and then change for AOS, but keep in mind the bureaucracy and the risk of messing it up altogether. Most people living already in the U.S. prefer AOS for a number of reasons, but you should first weigh all pros and cons for yourself and only then make any moves. If you have not violated any laws in the U.S., you are eligible for AOS. It also depends on the type of visas you entered the country. Some of them are excluded, if I'm not mistaken.

Посмотрите по 2004 году, я не знаю как было c курент номерами в 2004 и как будет примерно в 2005.
Я с 18,9** делал CP, потом получил H-1B в паспорт, вернулся в штаты по H-1B и ждал письма с иммиграционной визой от родителей уже в америке. Получил в начале июня. Интервью было в феврале + 4 месяца админ проверки (россиянин).
Я за CP, я много раз писал об этом, но выбирать предстоит для Вашего случая именно Вам и нести ответствыенность за Ваш выбор перед Вашей семьей.

Who told you that??? I have just finished DV2004 cases in that office - you can search for my post with the whole story

For those adjustment applications filed at the local office, please note effective February 17, 2004, the Philadelphia District Office will no longer process I-130/I-485 applications or any application submitted in conjunction with an I-485. This includes Form I-765, Application for Employment Authorization, and Form I-131, Application for Travel Document. We will accept the applications by mail or in person, with fees attached and forward them daily to the National Benefit Center for processing.
