Первый у PhD-ста есть, 4-й - только если есть работодатель (а откуда ему пока взяться, если нет статуса работать?), все остальные пункты - далеко не каждый с PhD имеет.

strehus, племянник моей жены получил Мастера в одном из здешних университетов, нашел работу по Н1, подал на GC по одному из этих вариантов и уже получил положительное заключение от Labor Dep. Так что вместо того, чтобы доказывать нам, что это невозможно, наймите хорошего адвоката и вперед.

Вот если б он просто имел мастера - то меня бы это весьма заинтересовало.
Мастер у меня уже есть, я продолжаю обучение - у меня есть вариант получить Грин-кард, пока я пишу PhD? Что-то я сомневаюсь.

Нелегалы уже тут. От них никуда не деться. Игнорировать их нельзя. Депортировать тоже фиг получится. Приставить к каждому по пограничнику - бюджет не выдержит.

Второе (ИМХО) отличие от Н1 в том что нигде не упомянуто о том, что "временный рабочий" должен получать не менее , чем американец.
