Unemployment insurance если уволился по семейным обстоятельствам

Чел. работает full-time в полу-государственной организации (не IT /Hightech) 5+ лет. Жалоб и нареканий не было, начальство, предположительно, довольно.

По семейным обстоятельствам (серьёзная болезнь члена семьи) вынужден на 4+ месяцев (а может и больше, а может и лет - зависит от состояния здоровья родственника) не работать. Чел взял 60 days leave, который скоро заканчивается и надо выходить на работу.

HR предлагает написать resignation letter. При этом, вроде как намекают, что если чел такое письмо не напишет, а просто по-тихому не выйдет на работу, то уволят всё-равно.

Есть ли шанс получить unemployment от штата (Юг)?

Как лучше это дело оформить? Писать или не писать resignation letter?

После увольнения в эту же организацию позже, повторно возьмут вряд ли. Работу по специальности найти будет трудно.

Короткий ответ - Да. Как я понимаю это зависит от условий конкретного штата. Например для West Virginia здесь всё разжевано (первая ссылка из Гугла).

Не факт. Я видел примеры людей, которые сами увольнялись по уважительной причине (без конфликта конечно), а потом, спустя полгода или несколько лет, их брали назад.

If you don’t meet the requirements, it doesn’t matter how serious your health issues may have been.

Без разницы, кмк, но опять же нужно искать применительно к вашему штату.
Reasons like these are called "good cause attributable to the employer."
Examples of personal reasons
Your own declining health,
Union rules,
In very limited cases, a lack of transportation,
Leaving to care for a sick family member,
Domestic violence, or
Leaving to take care of unexpected and urgent problems with the child care arrangements you have been using.

Штат в котором это всё происходит - такой великий секрет?
Например, в Техасе не будет unemployment benefits по этому конкретному поводу.
Quit for a good reason not related to work, under limited circumstances. Examples include leaving work because:
A personal medical illness or injury prevented you from working
You are caring for a minor child who has a medical illness
You are caring for a terminally ill spouse
You have documented cases of sexual assault, family violence or stalking
You entered Commission-Approved Training and the job is not considered suitable under Section 20
You moved with your military spouse

Почему только на 60 дней? FMLA на 12 недель, почти 3 месяца. Не зная всех деталей, сложно судить, но, если FMLA в этой ситуации применим, взять сертификацию врача и продлить до 3 мес. Поскольку согласно вашим словам есть риск что если человек уйдет, оброатно на то же место не вернуться, так же если риск высок найти схожую работу в данной локации, нанять сиделку и выйти на работу и балансировать таким образом. Увольняться если человек зависим от работы, дохода и возможности трудоустроиться в дальнейшем, последнее дело.

FMLA:

Covered family members under the Family and Medical Leave Act (FMLA) are the employee’s spouse, son, daughter or parent as defined in the FMLA Regulations Definitions.

Under the FMLA, a “spouse” means a husband or wife, including those in same-sex marriages, which were made legal in all 50 United States as of June 26, 2015.

The FMLA defines the term “parent” as “a biological, adoptive, step or foster father or mother, or any other individual who stood in loco parentis to the employee when he or she was a minor.”

“Son or daughter” means a biological, adopted or foster child, a stepchild, a legal ward, or a child of a person standing in loco parentis who is either under age 18 or age 18 or older and “incapable of self-care because of a mental or physical disability.” Information on FMLA leave to care for an adult child is found in the SHRM Q&A here.

Family members not covered by the federal FMLA include siblings, in-laws, grandparents and other extended family members unless those individuals stood “in loco parentis” to the employee when he or she was a minor. Nonfamily members can also be covered under the in loco parentis definition, which is defined as having had the responsibility of providing day-to-day care to the employee and of financially supporting the employee in his or her childhood.

Some states offer more generous coverage and broader definitions of family members under state family leave laws that often run concurrently with FMLA leave. Some states include siblings, grandparents, domestic partners and others in the definition of family member for the purposes of family medical leave. Employers are advised to review their states’ family leave laws for compliance.
