tax deduction for school tuition

Рассчитывать на списание Child and Dependent Care Expenses получится только в том случае, если вы оба работали или были full-time student:
http://www.irs.gov/publications/p503/ar02.html#d0e216
You (and your spouse if you are married) must have earned income during the year. (However, see Rule for student-spouse or spouse not able to care for self under Earned Income Test, later.)
...
Rule for student-spouse or spouse not able to care for self. Your spouse is treated as having earned income for any month that he or she is:
1) A full-time student, or
2) Physically or mentally not able to care for himself or herself.
Sincerely yours, VladStar.

The basics. If you’re in college, you – or the taxpayer who claims you as a dependent – have access to two credits that can reduce your tax. Both the Lifetime Learning credit and the Hope credit are “personal nonrefundable credits,” meaning they cannot reduce your tax below zero.
Eligible taxpayers. In short, if you, your spouse or dependent pays out certain education-related expenses, you qualify for the credits. Just as with most credits, the Lifetime Learning and Hope credits come with specific restrictions and phase-out limitations, such as:
The credits are not available if you’re married and file a separate return from your spouse, and
For 2003, the credits are phased out if modified adjusted gross income (MAGI) is between $41,000 and $51,000 ($83,000 and $103,000 if married filing jointly.) The income ranges are adjusted for inflation each year.
What’s a ‘qualified’ higher education expense? To qualify for these education credits, expenses must be for tuition and fees required for enrollment and attendance at an eligible educational institution. Eligible institutions include colleges, universities, vocational schools and other accredited post-secondary schools that can participate in United States financial aid programs.
Expenses qualify in the year they are paid for education that begins either in the same tax year or in the first three months of the following year.
Lifetime Learning Credit. This year, the maximum Lifetime Learning credit has doubled from $1,000 to $2,000, In other words, the credit is equal to 20 percent of the first $10,000 spent on qualified expenses, up from $5,000 last year.
The Lifetime Learning credit can be claimed for an unlimited number of years, but it is a per return credit, not a per student credit. So, if you’re a parent with two kids in college and both are listed as dependents on your return, you can only claim the credit once on your return.
Hope Credit. This credit carries more restrictions than the Lifetime Learning credit but still gives families a welcome tax break when coping with escalating college expenses. The Hope credit is equal to 100 percent of the first $1,000 of qualified expenses and 50 percent of the next $1,000. The maximum credit is $1,500 per year. Unlike the Lifetime Learning credit, the Hope credit is a per student credit, not a per return credit. The catch: it can be claimed only for the first two years of college for any student.
To claim the Hope credit, an eligible student must:
Be enrolled in a course of study that leads to a degree, certificate or other recognized credential;
Take at least one-half of a normal workload, by the school’s standards, for at least one academic period during the tax year;
Be free of any felony drug convictions;
Have not completed the first two years of post-secondary education at the beginning of the tax year, by the standards of the school; and
Have not claimed the credit for two years before 2003.
2003 Highlights
The cost for higher education is increasing at a rate greater than inflation as anyone paying for higher-education expenses will attest. The Tuition and Fees deduction offers you yet another tax incentive, of up to $3,000, to pursue a post-high school education. By taking advantage of the Tuition and Fees deduction, you can deduct undergraduate and graduate expenses for yourself, your spouse or your dependents and you don’t have to be a full-time student to deduct the costs. Only tuition and fees count, no room, board, or book costs are eligible.
There are income limits with the Tuition and Fees deduction and they are absolute. You also can’t claim the deduction if you take the Hope or Lifetime Learning credits for the same student in the same tax year. When deciding which education tax break to use, do the math. In almost all instances, a credit is preferable to a deduction.
The basics. If you want to take advantage of the Tuition and Fees deduction to earn a degree, you better hurry. The deduction is not available after 2005.
More about the Tuition and Fees deduction:
It's an adjustment to gross income;
It’s a per return/per year deduction;
It’s scheduled to increase for 2004 and 2005; and
Eligible expenses are tuition, activity fees, and course-related books, supplies and equipment that are required for enrollment at an eligible post-secondary institution or vocational school.
(Please note: The Tuition and Fees deduction is just one education benefit offered to taxpayers. The Press Kit also includes information on the Hope and the Lifetime Learning education credits.
Who's eligible: The Tuition and Fees deduction is available to taxpayers, their spouses, and their dependents who have qualified tuition and related expenses. It's not available to a taxpayer who is:
Married and files a separate return from his or her spouse;
Entitled to be claimed as a dependent on another taxpayer's return; or
A nonresident alien, unless he or she elects to be treated as a resident by filing a joint return with his or her spouse.
Calculating the deduction. The Tuition and Fees deduction is equal to 100 percent of eligible expenses, with a maximum limit of $3,000. But, if your modified adjusted gross income is over a specified amount, you can’t claim the deduction as shown in the table below.

Lifetime Learning Credit: You pay qualified education expenses of higher education. И что такое half time student. (Это я про фразу "The course must be either part of a postsecondary degree program or taken by the student to acquire or improve job skills.")

Be enrolled in a course of study that leads to a degree, certificate or other recognized credential;

Itemized deductions.

3000 Tuition and Fees deduction. Line 26 Form 1040 or line 19 Form 1040A.

Tuition, books, supplies, lab fees and similar items, cost of research and typing when writing a paper as part of an educational program.
If you use your car you can deduct your actual expenses OR use the standard mileage rate (36 cents per mile for 2003). Whichever method you use, you can also deduct parking fees and tolls. Costs of bus, subway, cab or others fares.
